Wir wissen, dass eine Transformation von globalem Ausmaß bereits begonnen hat, und wir wissen, dass ihre Entfaltung nicht vorhersehbar ist. Wir können sicher sein, dass es eine Herausforderung sein wird: Wir werden inmitten tiefgreifender Veränderungen leben, unser Überleben wird ständig auf dem Spiel stehen. Werden wir das Verständnis, die Weisheit erreichen, um diese Herausforderung zu bestehen? Hier sind einige Gedanken und Überlegungen, die uns helfen, den Zustand zu erreichen, in dem wir eine positive Antwort geben können. -/- Zurückblicken, um nach (...) vorne zu sehen -/- Dies wird nicht das erste Mal in der Geschichte sein, dass für die Menschheit eine Periode der Transformation auf globaler Ebene angebrochen ist. Der Wissenschaftsphilosoph Holmes Rolston wies darauf hin, dass unsere „große Geschichte“ drei solcher Transformationen umfasst – wahre „Urknalle“.1 Die erste war der physische Urknall, der vermutlich vor etwa 13,8 Milliarden Jahren stattfand. Es gebar das manifeste Universum mit seinen Quantenteilchen, vielfältigen Arten von Energien und Milliarden von Galaxien. Es führte zur Bildung von Sonnensystemen mit Sonnen und Planeten und Energieflüssen, die die Entwicklung von lebenden (glücklich gelegenen) Planeten ermöglichen, die aktive Sonnen umkreisen. Eine weitere grundlegende Transformation – ein „zweiter Urknall“ – war die Entstehung lebender Organismen in den komplexen Systemen, die sich auf der Erde und vermutlich auch auf anderen Planeten entwickelt haben. Die Kommunikation war nicht mehr auf halbautomatische Reaktionen beschränkt, die durch wiederkehrende Bedingungen und Ereignisse ausgelöst wurden; Anstatt sich auf Zeichen zu beschränken, basierte die menschliche Kommunikation auf einvernehmlich entwickelten Symbolen. -/- Die Entwicklung der Symbolsprache war ein großer Sprung. Einerseits brachte es soziale Strukturen hervor, die auf kollektiv erworbener Bedeutung beruhten, und andererseits produzierte es verbesserte manipulative Fähigkeiten. Gesellschaften könnten sich auf der Grundlage gemeinsamer Kulturen entwickeln, die mächtige Technologien einsetzen. Homo sapiens begann andere Arten zu dominieren und wurde zu einem Schlüsselfaktor in der Evolution des Lebens in der Biosphäre. Der dritte Urknall erzeugte eine Explosion der menschlichen Bevölkerung, aber er brachte nicht die Weisheit hervor, die sicherstellen würde, dass die erweiterte Bevölkerung das Gleichgewicht aufrechterhalten könnte, das für das Gedeihen des Lebens auf diesem Planeten unerlässlich ist. I defend social media’s potential to support Aristotelian virtue friendship against a variety of objections. I begin with Aristotle’s claim that the foundation of the best friendships is a shared life. Friends share the distinctively human and valuable components of their lives, especially reasoning together by sharing conversation and thoughts, and communal engagement in valued activities. Although some have charged that shared living is not possible between friends who interact through digital social media, I argue that social media preserves the (...) relevantly human and valuable portions of life, especially reasoning, play, and exchange of ideas. I then consider several criticisms of social media’s potential to host friendships, and refute or weaken the force of these objections, using this conception of a distinctively human shared life. I conclude that we should use the shared life to evaluate features of specific social media and norms for users’ conduct. (shrink)

Digital records, from chat transcripts to social media posts, are being used to create chatbots that recreate the conversational style of deceased individuals. Some maintain that this is merely a new form of digital memorial, while others argue that they pose a variety of moral hazards. To resolve this, I turn to classical Chinese philosophy to make use of a debate over the ethics of funerals and mourning. This ancient argument includes much of interest for the contemporary issue at hand, (...) including the use of impersonators of the dead to help the bereaved to deal well with their grief. I connect this historical discussion with a modern trend in clinical psychology that reframes therapeutic interventions with bereaved individuals. The trend directs practitioners away from facilitating detachment and toward affirming continuing bonds. I conclude that these chatbots can offer an important source of support to mourners, but also discuss parameters and features of social context that will be important to avoid the moral hazards identified by sceptics. Must the best friends necessarily be good people? On the one hand, as Aristotle puts it, ‘people think that the same people are good and also friends’. But on the other hand, friendship sometimes seems to require that one behave badly. For example, a normally honest person might lie to corroborate a friend's story. What I will call closeness, which I take to include sensitivity to friends' subjective values and concerns as well as an inclination to take their subjective interests (...) as reasons for action, is characteristic of friendship. But this seems to require that good friends should be morally flexible, more so than is compatible with a virtuous character. This would imply tension between ideals of friendship and ideals of character. But there is an important connection between virtue and friendship which arises precisely from friends' closeness, when concern for wellbeing, another important feature of friendship, is also taken into account. This helps mitigate the tension and shows how friendship and virtue are interconnected. The connection in turn provides friendship-based reason to think the best friends must be good people, even though concerns of friendship may occasionally clash with other moral concerns. (shrink)

En este trabajo analizamos la reivindicación gadameriana del valor cognitivo de arte como un ejemplo de un modo de conocimiento que permite concebir de mejor manera la comprensión que tiene lugar en las ciencias del espíritu. Dicha reivindicación presupone el desconocimiento del valor cognitivo del arte operado por la subjetivización de la estética con Kant y una vuelta a los presupuestos de la tradición humanista. Por ello en la introducción presentamos en esquema los conceptos humanistas de tacto, gusto, sentido común (...) y juicio y comparamos el concepto de experiencia que corresponde a los mismos con la noción de experiencia modelada por la ciencia moderna. En la primera parte del trabajo examinamos en detalle la subjetivización de la estética que comienza con Kant y culmina con la “conciencia estética”. En la segunda parte examinamos cómo la reivindicación del valor cognitivo del arte corre pareja con el desarrollo de una ontología de la obra de arte. Concluimos señalando cómo el recorrido realizado facilita la comprensión de la especificidad de las ciencias del espíritu (humanidades). (shrink)

The status and functioning of shame is contested in moral psychology. In much of anglophone philosophy and psychology, it is presumed to be largely destructive, while in Confucian philosophy and many East Asian communities, it is positively associated with moral development. Recent work in human-robot interaction offers a unique opportunity to investigate how shame functions while controlling for confounding variables of interpersonal interaction. One research program suggests a Confucian strategy for using robots to rebuke participants, but results from experiments with (...) educational technologies imply a different and potentially opposing account of shame’s role in personal development. By digging deeper into the details of Confucian theorizing about shame, I identify a unifying explanation for these apparently conflicting results. I conclude by offering suggestions for future empirical research in human-robot interactions to further investigate shame’s role in moral development. (shrink)

This paper asks whether a Nietzschean defense of the Christian valuation of human life is tenable. Nietzsche has long been noted for his anti-Christian stance in his writings. Despite his candid revulsion and antipathy towards Christianity, however, there are scholars who argue that Nietzsche is a “Christian,” because we can actually find a good number of Nietzschean ideas that coincide with the teachings of the Christian faith. Foremost of these ideas is Nietzsche’s insistence that life must be affirmed and valued (...) at all times — a position that perfectly resonates with the Christian doctrine on the value of human life. For this reason, in this paper, I aim to examine whether a Nietzschean defense of the Christian valuation of human life is tenable, given that Nietzsche’s writings abound with direct and scathing attacks against Christianity. Defensores do princípio da precaução propõem com frequência mudanças nas práticas científicas, para que elas facilitem o mesmo objetivo do princípio: evitar ameaças incertas ao ambiente ou à saúde humana. A ciência deveria ser uma ciência precautória. Apesar da importância prática da ciência precautória e da sua proximidade com os debates sobre ciência e valores, ela ainda não foi sistematicamente examinada. Neste artigo, pretende-se contribuir para a literatura sobre a ciência precautória de dois modos: sistematizando sua literatura prévia e propondo (...) uma definição de um de seus elementos principais, a precaução epistêmica, como uma orientação específica para a gestão de riscos indutivos. Conclui-se com algumas objeções que tal definição levanta, bem como caminhos de pesquisas futuras para abordá-las. (shrink)

Resumen: En este trabajo examino la concepción hegeliana del límite intentando clarificar sus principales características.Comienzo ubicando la filosofía hegeliana en el contexto filosófico más general del idealismo alemán, entendiendoeste movimiento como aquel comprometido en el proyecto de proporcionar una deducción trascendental de loabsoluto. Dado este contexto, procedo a examinar las críticas de Hegel a a la filosofía de Kant, principalmente en la“introducción a la Fenomenología del espíritu . El artículo concluye evaluando la adecuación de la elucidación deltratamiento hegeliano del problema (...) del límite mostrando como esta noción funciona en la interpretación del tratamiento hegeliano de la certeza sensorial en la fenomenología. -/- The problem of limit according to Hegel. In this paper I focus Hegelian conception of limit trying to clarify its main features. I begin locating Hegel’s philosophy in the broader philosophical context of German Idealism, understanding it as the intellectual movementconcerned with the project of providing a transcendental deduction of the Absolute. Having this as a background, Iexamine Hegelian critique of Kantian philosophy, mainly in the “Introduction” of Phenomenology of Spirit, and I conclude the paper testing the way I elucidated the problem of limit in this paper showing how this notion can beused to interpret the treatment of “sense certainty” in Hegel’s Phenomenology of Spirit. In quantum mechanics, the term “creativity” is amplified, since natural events form the constant transition from possibility to reality, according to the ontological probabilism of the Schrödinger equation. The completion of the quantum theory through the concept of the Grand Unified Theories, and especially through the yet incomplete superstring theory, reveals that at the micro level of creation of sub-atomic particles or space, motion literally comes prior to Being and objects are forms of a motion which suggests a constant transition (...) from possibility to reality. In non – linear physics of complex systems, the term “creativity” does not simply correspond to the initial emergence of the universe (big bang) or to the sub-atomic scale processes described by quantum mechanics, the Grand Unified Theories and the superstring theory, but is expanded to all aspects of nature: i.e. physical - chemical, ecological, psychological – mental aspect. So, through the non – linear physics theory, macroscopically viewed beings are constructed, holistic forms of motion, in order for the whole to gain a non reducible (therefore the whole is constantly being produced) ontological meaning which characterizes the operation of the part. Combining the theories of quantum mechanics and relativity, it could be stated that modern physics abolishes the customary perception concerning the natural phenomena, which were concerned as a constant transformation of a fundamental substance. On the contrary, the contemporary description of the natural world by physics and mathematics corresponds to Morphodynamics, i.e. the description of the world as creation of all cosmic shapes from a zero point, on all cosmic levels. From this point of view, zero is understood as the absence of shape, while the notion of an unshaped eternal substance is weakened and does not seem to be able to be justified by the evolution of scientific thought. The “beings” and their “substance” are assimilated to forms of movement that have already been created or that are being created, and constitute motion inside motion. (shrink)

The first part of this paper develops an outline of the history of hermeneutics organised around the problem of the method, understood as the question of guarantee of objectivity, the central problem of XIX century hermeneutics. In this outline XX century neo-Wittgensteinian philosophers like Peter Winch and Charles Taylor, appears as establishing the legitimacy of the methodological autonomy of hermeneutically oriented approach to social studies. Second part of the paper follows Georgia Warnke suggestion that specific Gadamerian contribution is to refuse (...) objectivity and intersubjective validity as necessary requisites for interpretation to be successful. We find in an analogy with phenomenological analysis of perception of material object and in hermeneutical analysis of the function of “distance” the grounds in Gadamer´s thought that supports this interpretation. We conclude assessing whether Gadamer position implies a methodological conclusion of the kind "everything goes" and which is the role intersubjectivity has to play in Gadamerian new scenery. Feminized AIs designed for in-home verbal assistance are often subjected to gendered verbal abuse by their users. I survey a variety of features contributing to this phenomenon—from financial incentives for businesses to build products likely to provoke gendered abuse, to the impact of such behavior on household members—and identify a potential worry for attempts to criticize the phenomenon; while critics may be tempted to argue that engaging in gendered abuse of AI increases the chances that one will direct this abuse (...) toward human beings, the recent history of attempts to connect video game violence to real-world aggression suggests that things may not be so simple. I turn to Confucian discussions of the role of ritualized social interactions both to better understand the roots of the problem and to investigate potential strategies for improvement, given a complex interplay between designers and device users. I argue that designers must grapple with the entrenched sexism in our society, at the expense of “smooth” and “seamless” user interfaces, in order to intentionally disrupt entrenched but harmful patterns of interaction, but that doing so is both consistent with and recommended by Confucian accounts of social rituals. Η αφήγηση του Οδυσσέα είναι μια σειρά από τυχαίες συναντήσεις. Η ζωή των ηρώων και η συμπεριφορά του έχει σχεδόν ενδεχομενικό χαρακτήρα και λέμε «Σχεδόν» — γιατί το κείμενο πρέπει να γραφτεί. Η ασήμαντη απρόβλεπτη λεπτομέρεια πρέπει να μετατραπεί σε σημάδι, ώστε στη συνέχεια να εγκαταλείψει ένα μέρος της εφήμερης ιδιότητάς της και να κοινοποιηθεί, που γίνεται μέρος του ίδιου του μυθιστορήματος του Joyce. Για να αποφευχθεί ο χαρακτηρισμός σε αποσπάσματα όπως αυτό που αναφέρθηκε παραπάνω από το να παραμείνει καθαρός (...) κατάλογος, προκύπτουν δύο στρατηγικές: (1) η ανάπτυξη μιας ελάχιστης αφηγηματικής δομής. και (2) η ανάπτυξη ενός συγκεκριμένου στυλ. Για τον Joyce, το στυλ κάνει τις λέξεις — ή συγκεκριμένες μονάδες γραφής, όπως φράσεις — να μετρούν από μόνες τους στη σχέση τους με άλλες λέξεις. Η ποίηση είναι η απόλυτη παρουσίαση ενός ύφους με αυτή την έννοια. Εάν ο Όμηρος σχηματίζει ένα δομικό ή αφηγηματικό σκηνικό στον Οδυσσέα, αυτό πρέπει να γίνει κατανοητό ως μια ανοιχτή δομή που μπορεί να φιλοξενήσει μια σχεδόν άπειρη σειρά περιεχομένων. Και λίγοι σχολιαστές απέτυχαν να παρατηρήσουν την ποιητική ποιότητα της γραφής του Joyce — ο μονόλογος της Μόλι Μπλουμ στο τελευταίο κεφάλαιο αναφέρεται ως χαρακτηριστικό παράδειγμα. Λιγότεροι, ωστόσο, μπόρεσαν να συνδέσουν το στυλ του Joyce με το πρόβλημα της γραφής που αντιμετώπιζε. The Zhuangzi to this day continues to be a hermeneutical challenge in that it always calls for new and fresh interpretations. In the past thirty years, however, various scholars have argued in their studies that the Zhuangzi does not only pose a hermeneutical challenge, but also carries an implicit hermeneutics. My aim in this paper is to show that underneath its parables and rhetoric, fictional and imaginary characters, as well as its inclination towards relativism and skepticism, a Zhuangzian hermeneutics comparable (...) to the hermeneutical theories of Paul Ricoeur and Hans-Georg Gadamer in the West subtly permeates the Zhuangzi. To attain this aim, I will first present and examine the three types of words in the Zhuangzi and do a Ricoeurian reading of these words. I will consequently identify the hermeneutics of skepticism implied in the Zhuangzi and argue that it is a hermeneutical approach that is dominant in the text. I will then contend that in addition to the hermeneutics of skepticism, the Zhuangzi also contains what I call a perspectival hermeneutics with a number of elements that echo Gadamer’s hermeneutical theory. Since Ricoeur has largely been identified with hermeneutics, he is very seldom associated with critical theory – a regrettable case since his hermeneutics actually holds the access to his critical theory. Hence in this paper I will explore the critical side of Ricoeur’s hermeneutics within the sphere of his interpretation of symbols. It is hoped that through this venture some of the aspects of the frequently ignored, disregarded, and forgotten relationship between Ricoeur’s hermeneutics and critical theory, will be brought to (...) light. The present paper deals with the consequences Kripke’s interpretation of Wittgenstein’s private language argument has for political and social thought. We will show this is particularly important because it challenges the framework where ordinarily is located the discussion of the political and social relevance of Wittgenstein’s thought. Classical discussion has been concerned mainly with the role of communitary agreement, its relativistic or conservative consequences, the room for criticism and disagreement that it leaves, etc. We discern in classical reading a commitment (...) with some epistemological problems (warrants for knowledge) which is not completely overcame, its semantic jargon notwithstanding. Instead, we will argue, the new framework proposed by Kripke, overcome this epistemological problematic, rising new concerns, close to which, in French contemporary thought, has been called “philosophies of the subjection of the subject”. El presente trabajo de Alex Ibarra Peña recoge los resultados de una investigación cuyo tema es la constitución de un campo de estudios ligado a la filosofía analítica en Chile. El autor se propone una tarea informativa y crítica en la que cifra la novedad de su propuesta. En otros términos, la suya es una labor de rescate, de algunos filósofos y corrientes de pensamiento relegados en las narraciones hegemónicas de la institucionalización de la filosofía en Chile y una tarea (...) que busca corregir el papel asignado a Chile en las visiones panorámicas de mayor circulación sobre la emergencia de la filosofía analítica en nuestro continente. En el cruce de estos dos vectores radica la novedad de la empresa de Ibarra Peña: proponer una visión más ajustada de la recepción de los filósofos analíticos en Chile. En nuestra reseña comentamos los núcleos centrales del trabajo y proponemos algunas hiótesis sobre los conflictos internos al campo cultural que subyacen a las opciones realizadas por el autor. Para finalizar indicamos lo que nos parece ser una falencia del trabajo: un estudio de la constitución de la filosofía analística como campo de estudios no debería dejar de tener en cuenta que el énfasis en la delimitación de la cientificidad por la filosofía analítica tenía en los años 60 y 70 adversarios concretos en el marxismo y el psicoanálisis. Zhuangzi suggests that death is a transformation that we commonly and mistakenly think means the end of someone but really just marks a new phase of existence. This metaphysical thesis is presented at several points in the text as an explanation of distinctively Daoist responses to death and loss. Some take a Daoist response to death, as presented by Zhuangzi, to indicate dual perspectives on friendship and death. But I argue that the metaphysical view sketched above is consistent with a (...) unified perspective, allowing the Daoist to enjoy deep friendships without risking some potential for grief typically associated with strong attachment. However, it leaves the Daoist best suited to friendships with those who endorse the same metaphysics. Furthermore, while the grief associated with the death of a friend is somewhat mitigated, the Daoist has reason to mourn even given this thesis. (shrink)

El presente trabajo es un estudio del libro de Martin Kusch acerca den las tesis sostenidas en "Wittgenstein on Rules and Private Language" (WRPL) por Saul Kripke examinado a la luz de la controversia desatada por la publicación del mismo en 1982, una de las más intensas que han ocurrido en los últimos 25 años en el seno de la filosofía analítica. En nuestro estudio procedemos en tres etapas. En la primera, presentaremos el desafío del Wittgenstein de Kripke de una (...) manera lo más neutral que podemos. En la segunda, presentaremos las características más notables trabajo de Kusch. En la tercera parte rebasamos los límites más estrictos de un comentario crítico para proponer una hipótesis propia acerca de la manera en la que la interpretación de Kusch permite comprender el vínculo de la propuesta de Kripke con la discusión clásica acerca del lenguaje privado como así también la discusión clásica permite realizar algunas observaciones críticas acerca de la propuesta de Kusch. En el presente trabajo examinaremos la tesis de Althusser que sostiene que la categoría de sujeto es un elemento constituyente de toda ideología. Debido a ello, la terna “ideología-interpelación-sujeto” poseería carácter omnihistórico. Sin embargo, algunos intérpretes encuentran un inconveniente en esta tesis, debido a la asociación del término ‘sujeto’ con la ideología burguesa. Para intervenir en este entramado de problemas nos proponemos tomar algunas indicaciones sobre la “evidencia del significado” y sus vínculos con la “evidencia del sujeto” que han sido (...) propuestas por Michel Pêcheux. En particular reflexionaremos sobre a constitución de los individuos en sujetos en la ideología, su “reclutamiento” y la exhaustividad que le compete. Nos apoyaremos en este desarrollo en algunas observaciones de Wittgenstein. (shrink)

En el presente trabajo intentaremos mostrar la relevancia del planteo filosófico wittgensteiniano para la fundamentación y el desarrollo de una teoría materialista del discurso. Tomaremos como punto de partida para examinar esta tesis la propuesta de una teoría materialista del discurso desarrollada por Michel Pêcheux (1938-1983). Pêcheux fue un pensador marxista, discípulo de Louis Althusser, a quien habitualmente se ubica en los orígenes de lo que se conoce como “Escuela francesa de Análisis del discurso”2. En nuestro trabajo nos concentraremos en (...) los supuestos filosóficos de su concepción del discurso, puesto que en los mismos hallamos una caracterización filosóficamente interesante de la posición materialista, convergente en muchos de sus desarrollos con la filosofía de Wittgenstein. Δύο επίμονα θέματα ζωντανεύουν όλη τη γραφή του Αλμπέρ Καμύ και αποτελούν τη βάση του καλλιτεχνικού του οράματος: Το ένα είναι το αίνιγμα του σύμπαντος, το οποίο είναι εκπληκτικά όμορφο αλλά αδιάφορο για τη ζωή. Το άλλο είναι το αίνιγμα του ανθρώπου, του οποίου η λαχτάρα για ευτυχία και νόημα στη ζωή παραμένει άσβεστη από την πλήρη επίγνωση της δικής του θνητότητας και της κυρίαρχης αδιαφορίας του περιβάλλοντός του. Στη ρίζα κάθε μυθιστορήματος, κάθε θεατρικού έργου, κάθε δοκιμίου, ακόμη και κάθε (...) καταχώρησης στα τετράδιά του βρίσκεται η αδιάκοπη ανάγκη του Καμύ να διερευνήσει και να προβληματιστεί για τον ειρωνικό διπλό δεσμό που αντιλαμβανόταν ότι ήταν η ουσία της ανθρώπινης κατάστασης: Ο άνθρωπος είναι προικισμένος με τη φαντασία να συλλάβει μια ιδανική ύπαρξη, αλλά ούτε οι συνθήκες, ούτε οι δικές του δυνάμεις επιτρέπουν την επίτευξή της. Η αντίληψη αυτού του απελπιστικού διπλού δεσμού έκανε αναπόφευκτη στον Καμύ την υποχρέωση να αντιμετωπίσει ένα κυρίαρχο ηθικό ζήτημα για τον άνθρωπο: Δεδομένης της περιορισμένης κατάστασης του ανθρώπου, υπάρχουν έντιμοι όροι με τους οποίους μπορεί να ζήσει τη ζωή του;. En su célebre artículo sobre la ideología y los aparatos ideológicos de estado, Althusser indicaba que las evidencias por las cuales una palabra “designa una cosa” o “posee una significación” se ubicaban, junto con la evidencia de ser sujetos, al nivel de los efectos ideológicos fundamentales. Por otra parte, Althusser destacaba la carencia de una teoría de la garantía ideológica. Con la primera observación, Althusser se limitaba a señalar un paralelo, sin establecer una conexión. Con la segunda, llegaba a fijar (...) una meta teórica. En el presente trabajo intentaremos reconstruir el trayecto recorrido por Michel Pêcheux para establecer una conexión allí donde Althusser designó una analogía, e intentaremos mostrar cómo el desarrollo de esta conexión permite establecer las líneas generales de una teoría de la garantía ideológica. Nos concentramos en Les vérités de La Palice (1975), en particular en la operación que, siguiendo los límites de lo que Pêcheux denomina “el materialismo de Frege”, intenta convertir en regla lo que en el campo del pensamiento fregeano se presentaba como un non-sens: que el sentido de las palabras, expresiones y proposiciones se viera afectado por su asociación con otras palabras, expresiones y proposiciones. A partir de allí seguimos la construcción de los conceptos fundamentales con los que Pêcheux intenta definir un “nuevo objeto”: formación discursiva, proceso discursivo, interdiscurso, discurso transverso e intradiscurso, guiado por dos mecanismos discursivos extrapolados de la reflexión fregeana: el de lo preconstruido y el de la articulación o efecto de sostén (grosso modo: procesos metafóricos y metonímicos). Intentaremos destacar dos puntos: que los mecanismos discursivos identificados están sometidos a una divergencia (décalage), a partir del cual pueden comenzar a pensarse las paradojas de la interpelación ideológica sin sucumbir a sus evidencias. La divergencia a la que aludimos consiste en que la inscripción del proceso sin sujeto en la ideología requiere la duplicación de los elementos para que puedan actuar sobre sí como si fueran otros que sí mismos. Insistiremos en que es esta divergencia o contradicción, interna a la forma sujeto, y no la propia forma sujeto, lo que constituye el motor del proceso. Por otra parte, intentaremos mostrar que los dos mecanismos aludidos dan lugar a una concepción dual del sujeto ideológico, por el cual éste está sometido a la “garantía empírica”, por la que el sujeto se identifica a sí mismo, a los otros y al mundo de objetos que lo rodea, y a la “garantía especulativa”, que produce el retorno de lo universal de la formación discursiva en el discurso del sujeto. El paso continuo de una forma de garantía a la otra (de la posición del sujeto del discurso como enunciador a su posición de sujeto universal, pretendido “sujeto de la ciencia” por medio de la identificación con el otro) da cuenta del hecho de que “la ideología no tiene afuera”, ya que tiende a absorber espontáneamente cualquier discrepancia en la forma sujeto, o ruptura con la misma, en el interior de la forma sujeto. Most studies on Nietzsche seldom associate him with the dialectic method. We readily think of Socrates, Hegel, and Marx when we hear of dialectic, but very rarely, if at all, of Nietzsche. To date, very few studies on Nietzsche have claimed that one of the German philosopher's underpinning philosophical methodologies in his literary oeuvre is the dialectic. This paper thus intends to show that Nietzsche has been employing the dialectic throughout his writings, especially in his treatment of the "free spirits"-a (...) recurring subject in his different compositions. To do this, I will first revisit the meaning of dialectic in Socrates, Hegel, and Marx and subsequently argue that in Nietzsche, a type of dialectic akin to Hegel's permeates his writings. In the next parts of this paper, I will discuss in-depth how for Nietzsche, the incarnation of the free spirits involves not just one, but a continuum of triple dialectic. I will argue that to become a free spirit, one must constantly apply the dialectics of (1) criticality and openness, (2) unlearning and relearning, and (3) overcoming and becoming. These dialectics, in my view, are the necessary conditions for any individual to be truly free. In this paper, I will importantly highlight that these dialectics run through Nietzsche's works starting from the early up to the final period of his literary productivity. (shrink)

There are two basic views concerning the relationship between constitutional rights and proportionality analysis. The first maintains that there exists a necessary connection between constitutional rights and proportionality, the second argues that the question of whether constitutional rights and proportionality are connected depends on what the framers of the constitution have actually decided, that is, on positive law. The first thesis may be termed ‘necessity thesis’, the second ‘contingency thesis’. According to the necessity thesis, the legitimacy of proportionality analysis is (...) a question of the nature of constitutional rights, according to the contingency thesis, it is a question of interpretation. Δεν φαίνεται πολύ σοβαρό, εκ πρώτης όψεως, να υποστηρίζουμε ότι η «ανθρωπότητα που θα έρθει» μπορεί να έχει δικαιώματα. Η απλή κοινή λογική θα υποστηρίξει ότι αυτό που δεν υπάρχει – ή αυτό του οποίου η ύπαρξη είναι προβληματική – δεν μπορεί να έχει δικαιώματα. Μόνο φυσικά ή νομικά πρόσωπα ικανά να τα διεκδικήσουν, δηλαδή να τα διεκδικήσουν με υποκείμενα ή φορείς που έχουν τη σχετική υποχρέωση να τα προστατεύσουν, μπορούν να επωφεληθούν από τα «δικαιώματα», με τη στενή έννοια αυτού (...) του όρου. Αυστηρά μιλώντας, επομένως, ούτε τα συλλογικά όντα (ζωικά είδη) ούτε τα πράγματα (δέντρα, βράχοι κ.λπ.) ούτε τα «όντα της λογικής» («ανθρωπότητα») δεν μπορούν να έχουν δικαιώματα: εκτός εάν συγχέονται τα νόμιμα δικαιώματα. (πράγμα που συνεπάγεται νόμο και κύρωση) και ηθικό δικαίωμα που είναι μόνο μια απροσδιόριστη απαίτηση, και επομένως αμετάφραστη σε νομικούς όρους (όπως το δικαίωμα των παιδιών να αγαπιούνται για παράδειγμα...). Ή για να το θέσω διαφορετικά: δεν μπορεί να υπάρξει δικαίωμα χωρίς σύμβαση τουλάχιστον σιωπηρή, τουλάχιστον δυνητική, και χωρίς αμοιβαιότητα συμφωνημένη μεταξύ όλων των συμβαλλόμενων μερών. El presente artículo analiza la etapa denominada arqueológica de Michel Foucault. Puntualizando principalmente cómo en esta etapa es entendido el concepto de libertad desde la noción foucaultiana de discurso. Se aborda, en este sentido, la etapa arqueológica de Foucault desde tres áreas. La primera, nos habla de cómo se erige lo diferente, lo anormal. La segunda, expone cómo se construye lo aparente, lo indiscutible. Por último, a partir de un marco teórico previamente expuesto, reflexionamos respecto del concepto de libertad.

Η ιστορία και η φιλοσοφία της επιστήμης χαρακτηρίζονται τόσο από λόγο όσο και από αντίλογο: στη θέση ότι υπάρχουν διαχρονικά κριτήρια/αξίες που διέπουν την επιστημονική δραστηριότητα, αντιπαρατίθεται η αντίθετη θέση, η οποία υποστηρίζει τη συγχρονική, τοπική και υποκειμενική έκφανση αυτών των κριτηρίων. Στην ορθολογικότητα της επιστημονικής σκέψης που δικαιώνει τη συνεχή διεύρυνση της εξηγηματικής ισχύος της επιστήμης, την επιστημονική εξέλιξη δηλαδή, αντιπαρατίθεται το μη ορθολογικό και ενδεχομενικό στοιχείο που υποστηρίζει την ασυνέχεια της επιστημονικής εξέλιξης.

The rational explanation of the excerpts and the intuitive apprehension of the Wholeness are required to combine and create the open thought and the holistic knowledge. This means that the measurement should be defined by the ''measure'', but the responsibility for determining the ''measure'' depends on the man.
